Introduction
These Terms of Use ("Terms") govern your access to and use of Maillo ("Service"), business email at your own domain provided by Maillo ("Maillo", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you are using Maillo for an organisation, you agree on its behalf and confirm you are authorised to do so. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old or meet your country's minimum legal age to use Maillo. By using the Service, you confirm that you meet these requirements and are using Maillo where it is legally available.
Privacy
Your privacy matters. Please review our Privacy Policy to understand how we handle your data.
Your account and workspace
You are responsible for your account, for keeping your password safe, and for everything that happens in your workspace, including what people you invite do there. Admins can add and remove people, change roles and manage shared addresses. Tell us right away at [email protected] if you think your account has been compromised.
Your domain
You may only connect a domain you own or are authorised to use. You manage your domain's DNS records at your registrar or DNS provider; Maillo can only deliver and sign mail for your domain while the required records are in place. Changes you make to your DNS, or problems at your registrar, can interrupt your email.
Acceptable use
You agree to use Maillo lawfully and responsibly. You must not use it to send spam or unsolicited bulk email, phishing, malware or fraudulent messages; to impersonate others; to send mail to purchased or scraped address lists; to infringe others' rights; or to interfere with the Service or other users. To protect deliverability for everyone, we may limit, suspend or stop sending from an account that breaks these rules or causes high bounce or complaint rates, and we may terminate accounts for serious or repeated misuse.
Your content
You keep all rights to the email and files you send, receive and store with Maillo. You give us permission to store, process and transmit that content only as needed to provide the Service. You are responsible for having the rights to the content you send.
Intellectual Property
The Service, including its software, design and branding, belongs to Maillo. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms.
Third-party services
Maillo runs on infrastructure from third parties, including Amazon Web Services and Cloudflare, and payments are handled by Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Purchases are also subject to Paddle's buyer terms.
Seats and billing
Maillo is billed per seat: each person in your workspace uses one seat, charged monthly at the price shown on our website when you subscribe. You can add seats at any time; seat changes are prorated, so adding seats is charged for the rest of the month and removing seats credits the unused time toward future invoices. Removing a person frees their seat, and you can lower your seat count to the number of people you have. Taxes are calculated and collected by Paddle where applicable. Your subscription renews automatically each month until you cancel. If we change our prices, we'll tell you by email before the new price applies to your next billing period.
Refunds and cancellation
We don't offer refunds. You can cancel at any time; your workspace stays active until the end of the period you've paid for, and you won't be charged again. See our Refund Policy for details, including rights you may have under consumer law.
Email Consent
By using Maillo, you agree to receive emails related to your account and the Service, such as invitations, DNS alerts and billing notices. You can unsubscribe from product news at any time.
Modifications & Termination
We may change or discontinue features of the Service. If we discontinue the Service as a whole, we'll give you reasonable notice so you can move your email elsewhere. You may close your account at any time. We may suspend or terminate access for violations of these Terms. After an account is closed, its data is deleted as described in our Privacy Policy.
Disclaimer of Warranties
Maillo is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We work to keep the Service reliable, but we don't guarantee it will be uninterrupted or error-free, or that every message will be delivered.
Dispute Resolution
Any disputes shall be resolved through mediation or arbitration and governed by the laws of Delaware, United States.
Indemnification
You agree to indemnify and hold harmless Maillo from any claims or liabilities arising out of your use of the Service, the content you send, or your violation of these Terms.
Limitation of Liability
Maillo's liability is limited to the fullest extent permitted by law. We are not liable for indirect or consequential damages, or for lost data, profits or business. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
Force Majeure
We are not responsible for delays or failure to perform due to events beyond our control, including natural disasters and outages of our providers.
Governing Law
These Terms are governed by the laws of Delaware, United States. You consent to the jurisdiction of Delaware courts.
Changes to these Terms
We may update these Terms. We'll post the new version here with a new date and tell account owners by email about significant changes. Continuing to use Maillo after a change means you accept the updated Terms.
Severability
If any part of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
Miscellaneous
These Terms do not create a partnership or joint venture. Waivers of any part of these Terms do not constitute a waiver of others. Rights and obligations may not be transferred without our consent.
